In this article, the right to health is discussed as a social right and an essential requisite in the construction and guarantee of human rights, more precisely human dignity, considering this right as a complex but effective process in the transformation of the social reality. In the first place, the activities of the public power and its difficulties to guarantee universal access to health are highlighted. This scenario ends up inhibiting the practice of the right to health and prevents users (...) from enjoying and using it. In that sense, this article challenges and explores some alternatives to solidify and put in practice the right to health in Brazil. Departing from the analysis of the Unified Health System and social participation in Brazil, this article discusses the judicialization of health in the country, highlighting the difficulties the State faces to equitably offer universal healthcare to society. This context offers an opportunity for reflection and a paradigm change, from the “judicialization of health” to the “judicialization of health policies.” Finally, the public health policies adopted by other countries are emphasized, in the attempt to construct the empowerment of human beings in the practice of their rights, particularly social participation and the discussion about the States’ responsibility to put their citizens’ right to health in practice. In conclusion, the political and collective construction of the right to health needs to be encouraged, distinguishing the legitimate interests of the different interlocutors involved. (shrink)

This paper is a response to the opening of new lines of research on CSR and SMEs (Thompson & Smith, 1991; Spence, 1999; Moore & Smith, 2006; Spence, 2007). It seeks to explore the business case for CSR in this corporate segment. The paper, which is based on four case studies of medium-sized firms in the automotive sector, took the distinctive approach of trying to understand the nature of CSR-like activities developed not by best-in-class CSR-driven companies but by purely competitiveness-driven (...) firms. The case studies provide explicit evidence that the CSR activities of SMEs and the notion of social capital are interrelated, turning social capital into a powerful instrument to better explain what academic literature has called silent CSR practices . The analysis that follows questions some of the basic tenets that underpin the branch of business ethics that deals with the nature of SMEs' approach to CSR. Four basic concerns, which take the form of propositions for further research, serve as the basis for this analysis: a) A definition of CSR that includes most of the actions taken by all companies in the territory contributes no academic value to the discipline b) Any study of the motivation behind these CSR actions must reflect their essentially pragmatic nature. Actions are linked to social values but also, more importantly, to the nature of the competitive environment c) Business ethics must seek common ground with other more sociological disciplines if it is to explain the reasons behind this type of action d) Any study of this kind of practice requires a dual approach: a) normative when using tools developed by CSR; and b) descriptive and instrumental using the notion of social capital. The current crisis has come at a cost not only for big business but also for business schools. Business schools have been deemed largely responsible for developing and teaching socially dysfunctional curricula that, if anything, has served to promote and accelerate the kind of ruthless behavior and lack of self-restraint and social irresponsibility among top executives that have been seen as causing the crisis. As a result, many calls have been made for business schools to accept their responsibilities as social (...) institutions and to work toward becoming more socially embedded and better attuned to public interests. In this paper, however, we point to some of the barriers there may be in the way of business schools developing into responsible organizational citizens proper. We argue that there are lines of resistance against responsibilization operating at epistemological, institutional, and organization levels and that we need to take account of barriers on all these levels in order to properly capture the challenges that are involved in making the modern business school amenable to demands for more social responsibility. In terms of working toward overcoming such barriers, we discuss how business education can become more socially embedded via the inclusion of ethical reflection and critical thinking. (shrink)

This study evaluated the functioning of children in early childhood education classroom routines, using the 3M Functioning in Preschool Routines Scale. A total of 366 children aged 36 to 70 months and 22 teachers from six early childhood education centers in Spain participated in the study. The authors used the Rasch model to determine the item fit and the difficulty of the items in relation to children's ability levels in this age range. The Rasch Differential Item Functioning analysis by child (...) age groups showed that the item difficulty differed according to the children's age and according to their levels of competence. The results of this study supported the reliability and validity of the 3M scale for assessing children's functioning in preschool classroom routines. A few items, however, were identified as needing to be reworded and more difficult items needed to be added to increase the scale difficulty level to match the performance of children with higher ability levels. The authors introduced the new and reworded items based on the results of this study and the corresponding ICF codes per item. Moreover, the authors indicate how to use the ICF Performance Qualifiers in relation to the 3M scale response categories for developing a functioning profile for the child. (shrink)

In order to highlight the intimate relationship between imagining, drawing and making worlds, this essay questions the educational meaning of children to initiate in the action of drawing in face of the growing cultural tendency of the body being less and less required to produce senses. The incarnated action of drawing, as an aesthetic action of touching and being touched by the world when transposing the visible limits and entering into the intimacy of worldly invisibility, constitutes an experience that is (...) as recurrent and trivialized in school daily life as it is existentially complex due to its poetic power to enter the invisible and inaugurate worldviews. The historical disqualification of the image and imagination in Western thought, supported by the separation between subjectivity of the body and objectivity of the world, does not allow educational thought to consider the phenomenon of poetic imagination as an existential experience of language insertion in the world from the gesture of drawing. Gesture that finds its specificity in the instant the hand traces and inscribes lines on the surface of the supports as infinitely creative writing. The aesthetic gesture of drawing, temporalized by the rhythm of the body in the emergence of the fabulation that accompanies the repetition of the marks, implies a poetic experience of language that involves the fusion of two senses: that of the gesture in materiality and that of the mark configured in it, marked and cicatrized in the surface of the support by the body’s action that performed it. The approximation between education, arts and childhood allows us to highlight the philosophical and pedagogical tensions that involve the question of poetic imagination and to take another look at the action of drawing in the context of children's education. What emerges, from the dialogue between Gaston Bachelard, Maurice Merleau-Ponty and Jean-Luc Nancy, is the relevance of the educational intention of caring for the vital function of language as an aesthetic and poetic experience that is constituted in the processuality of the body to make something appear that produces and contains presence, that which promotes and expands the existential density of the real. In this paper, we challenge one of the criticisms against the idea of a universal basic income, namely, that people will waste the support on high-end consumption. We rely on the literature from various disciplines from which we developed high- and low-UBI scenarios for respondents to decide what they would do if the state were to provide an unconditional stipend. We analyzed the multiple-choice responses, using an ordered probit, and the written explanations of the respondents’ choices, using content analysis. The (...) results suggest that while a higher UBI would increase consumption, it would likely be done responsibly. People with low incomes showed restraint in all categories. The qualitative analysis captures some of the complexities of people’s socioeconomic circumstances that support the notion of responsible consumption. The policy implication is that a UBI could be introduced at a low level and gradually increased to a level that maximizes societal benefits. (shrink)

In his second book on being and event, Logics of Worlds, Alain Badiou describes Plato’s late dialogue, The Sophist as “one of the first transcendental inquiries in the history of thought”. In this dialogue, Plato introduces what he calls the Idea of the Other, the possibility of a being of non-being, an inevitable break with the Parmenidean tradition. However, according to Badiou, Plato fails to provide an example of how this Idea of the Other can manifest itself or be effective (...) in a world, or in other words, appear. This paper argues that not only there is such an example in Plato’s Sophist, namely, the phantasma, but also that it can be strongly related to Badiou’s philosophical system. (shrink)

Education moves in the space of distance between those who are coming into the world and the world that they arrive. Since Modern Age, this distance formed by the opposing subject and object, has tended to be an impassable abyss. In this way, the world unfolds in two: the world whose image under investigation in the field of Education is the blackboard, and the world of everyday life. In front of the blackboard the student is installed, constituted as a subject, (...) which should curtail the reality until it fits with the security and accuracy of mathematical world-object-blackboard. The world of ordinary life is there and education does not know what to deal with it, and have it for non-existent. The reality held by non-existent prevents people’s existential integration. But there’s another kind of Educations that integrates and includes subjective and objective world and needs the courage to accept and even demand the new perspectives of those who are coming to build a more complete and always risky world. The aim of this study is to analyze the relationship between rhythmic movements and deictic gestures at the end of the first year of life, and to focus on their unimodal or multimodal character. We hypothesize that multimodal rhythmic movement performed with an object in the hand can facilitate the transition to the first deictic gestures. Twenty-three children were observed at 9 and 12 months of age in a naturalistic play situation with their mother or father. Results showed that rhythmic (...) movements with objects in the hand are a frequent behavior in children's repertoires. Rhythmic behaviors tend to decrease from 9 to 12 months, specifically when they are unimodal. Multimodal rhythmic behavior production at 9 months is positively related with proximal deictic gestures 3 months later. Multimodal rhythmic movements are not directly related to distal deictic gestures, but are indirectly related via proximal deictic gestures. These results highlight the relevance of multimodal behaviors in the transition to the use of early gestures, and can be considered as a transitional phenomenon between the instrumental action and early communicative gestures. This article explores the process of teaching Christian theological ethics beyond the common focus on European and North American sources. In conversation with moves to decolonise university curricula, the article proposes a theology of listening, an example of a research seminar for master’s and doctoral students at the University of Aberdeen on Christian ethics beyond Europe and North America, and an exploration of broader challenges for the formation of the theologian. The article asks, what can we learn when we give (...) up power and control when teaching and learning theology? How can we shift our methods of knowing and practising theology? We write as theologians from India, Mexico, and the United States living in the United Kingdom. We reflect on forms of exclusion in theological method and formation that arise from colonising, systemic violence, and inequalities. The article considers intercultural challenges when encountering different methods of reflection on the Christian experience. In a search for a more profoundly theological approach, we propose listening to the other as integral to doing theology. In an intercultural move, we draw on Dietrich Bonhoeffer's theology of listening, proposing that theology must be an advent of voices from beyond our usual places and methods. (shrink)

Victory is the ultimate aim in high performance sports; when it comes to team sports, the goal is the key that allows players to achieve that victory. This is the case with futsal which, due to its internal structure as well as the speed in the development of its game, makes the achievement of a goal not an isolated event, but rather more than one goal must be scored to achieve victory. The aim of the present study is to analyze (...) the construction of offensive sequences that have resulted in goal-scoring in the two main European futsal leagues, the Spanish and the Italian, as well as to identify the patterns relating to offensive actions that have ended with a goal being scored. Observational methodology was used to develop the research and an ad hoc observation instrument was developed for this purpose. The data was analyzed using inferential statistics as well as sequential analysis of delays in a diachronic analysis to identify the patterns of offensive actions. The results obtained enable recognition of a league’s idiosyncrasy patterns in goal-scoring in each of the leagues studied. The results obtained will allow experts to have a better understanding of how goals are scored and how to establish more specific training tasks, in both attack and defense. (shrink)

Patriarchal institutions govern all aspects of women's lives: their minds, their bodies, and their souls. Additionally, they govern the ways in which women are perceived by others and the ways in which women perceive themselves. (Re) Interpretations: The Shapes of Justice in Women's Experience, is a collection of essays on language, religion, war, sex trafficking, and medicine-the patriarchal structures that form the basis of western society and, thus, are in many ways inherently unjust. The essays illustrate the multitude of ways (...) that women have found to work within and without these structures to create justice. Traditional theories of justice cast it as a cardinal virtue, unbiased and impartial. The essays in this book, however, remove justice from the abstract and return it to the specific: most of the essays use personal narratives to highlight the connections all people share. The women discussed here are challenging the authority of existing patriarchal narratives by telling their versions, and, thus, calling attention to and challenging their own political and social realities. El análisis, que evalúa los aspectos históricos recreados por el autor en el relato, confronta las fuentes históricas que éste utiliza para la construcción de su cuento e intenta indagar en la posición desde la que se interpretan literariamente los hechos, en la cual el erotismo es fundamental. The academic literature reveals the need to undertake more in-depth field studies in order to discover the organisational culture, the difficulties and the perceptions surrounding CSR in SMEs. This study presents the results of analysis of four case studies on Catalan companies that stand out for their social and environmental practices. The conclusions of this paper are the result of dialogue with the main actors – four medium-sized companies – focusing on their actions, understandings and resistance with regard to CSR. (...) The methodological perspective used was Grounded Theory, with the aim of the study being to contribute towards formalising CSR in SMEs, in their daily practices, by analysing some primary data. The results obtained show how difficult it is for SMEs to understand CSR, beyond the explanation of the specific practices carried out by the companies. They highlight the role played by the values of the founding director in the implementation of CSR programmes; they reveal that SMEs still have a long way to go towards learning how to inform both internal and external stakeholders of their best practices, and; finally, they show the interesting links that SMEs establish between responsible practices, improved competitiveness and economic results. Finally, the text points out the implications that the results of this analysis may have on creating ways of promoting CSR in SMEs. We believe that, in light of the opinions expressed by the companies, public organisations should try to concentrate on creating a favourable framework for responsible competitiveness, as a way to deal with CSR when addressing SMEs. In the middle of the twentieth century, Wittgenstein warned that “the method of reducing the explanation of natural phenomena to the smallest possible number of primitive natural laws…leads…into complete darkness” (1958, p. 18). At the time, few philosophers and even fewer scientists were prepared to heed his warning. A half-century later, however, the reductive method of science—the method famously defined by Descartes, brilliantly exemplified by Newtonian physics, and long upheld as the gold standard of scientific explanation—seems to have finally lost (...) its luster. While reduction is still widely defended, in the last decades alternative views have gained credibility, to the extent that a “non-reductive science” is no longer dismissed as an oxymoron. (shrink)

La existencia de representaciones del cuerpo, en especial aquellas que se requerirían para actuar, ha sido objeto de largas controversias. El objetivo de este artículo es defender la idea de que hay representaciones del cuerpo involucradas en la realización de acciones cotidianas. Nuestra tesis será que lo que realmente muestran algunas dudas sobre este tipo de representaciones es que deben tener cierto tipo de contenido no-conceptual. Primero, abordamos dichas dudas, mostrando que no refutan la existencia de las representaciones en cuestión. (...) Sin embargo, señalamos que contienen dos intuiciones clave para cualquier caracterización del contenido de dichas representaciones. Así, pasamos a proponer una caracterización tal, que acomode adecuadamente las intuiciones señaladas. El proyecto de investigación “Del canon a las márgenes: revisión crítica de la poesía en Colombia, siglo xx” dio pie a la invitación para reunir en este número distintas reflexiones sobre la literatura en las márgenes. En cada caso el propósito principal consistió en identificar y documentar manifestaciones poéticas del ámbito iberoamericano que puedan ser interpretadas como omplementarias o alternativas a los hitos y autores tenidos como canónicos. En otras palabras, dar cuenta de las transformaciones de la poesía; valga decir: (...) formas, expresiones y contenidos deliberantes, diversos, mediáticos, interculturales, etcétera, desprendiéndolas de la concepción restrictiva del canon para afirmarlas a cambio en las voces que, desde las identidades culturales, las posiciones autónomas o marginales, sustentan visiones y versiones alternativas del ser y el hacer humano. John Dewey (1859-1952) es reconocido por dar continuidad al legado de las primeras elaboraciones del pragmatismo de Charles Pierce y Williams James y a su vez por desarrollar su propio análisis sobre la dimensión social y política de este movimiento filosófico, aporte que sustenta las contribuciones a otros campos del saber y de manera especial a la pedagogía. La reflexión sobre la educación representa un asunto central en el pensamiento del filósofo estadounidense, desde el desarrollo teórico reflejado en su prolífica (...) obra clasificada como pedagógica y en su actividad política en el movimiento progresista. La doble arista de la vida de Dewey es coherente con uno de los principios pedagógicos promulgados por él: la unión indisociable entre la dimensión moral e intelectual en la formación humana a través de la experiencia, aspecto que fundamenta su crítica a la educación tradicional de su tiempo, la cual propende por el desarrollo de capacidades intelectuales hacia un fin último (apropiación de asignaturas escolares o preceptos morales), fenómeno que se evidencia en la imagen del ciclo escolar como proceso que prepara al niño para la vida adulta por encima, o mejor, a pesar de su experiencia presente. El análisis sobre dicha relación es tratado ampliamente en el texto Moral Principles in Education, publicado por primera vez por Dewey en 1909 bajo el auspicio de la firma Houghton Mifflin Company, de ee uu., y difundido en 2008 en su versión electrónica por el Proyecto Gutenberg, de donde se extraen los fragmentos originales que en esta edición se traducen al español. Por las razones señaladas, se considera fundamental para la filosofía de la educación contemporánea la difusión de la citada obra en lengua castellana, por la vigencia de sus planteamientos en la reflexión del papel de la escuela, pero sobre todo de la educación, en la formación moral del sujeto, no como un asunto del futuro ciudadano, sino como un aspecto inherente a la vida escolar cotidiana. A long‐standing debate in the study of human communication centers on the degree to which communicators tune their communicative signals (e.g., speech, gestures) for specific addressees, as opposed to taking a neutral or egocentric perspective. This tuning, called recipient design, is known to occur under special conditions (e.g., when errors in communication need to be corrected), but several researchers have argued that it is not an intrinsic feature of human communication, because that would be computationally too demanding. In this study, (...) we contribute to this debate by studying a simple communicative behavior, communicative pointing, under conditions of successful (error‐free) communication. Using an information‐theoretic measure, called legibility, we present evidence of recipient design in communicative pointing. The legibility effect is present early in the movement, suggesting that it is an intrinsic part of the communicative plan. Moreover, it is reliable only from the viewpoint of the addressee, suggesting that the motor plan is tuned to the addressee. These findings suggest that recipient design is an intrinsic feature of human communication. (shrink)

Critical scholarship often presents corporate social responsibility (CSR) as a reflection or embodiment of neoliberalism. Against this sort of sweeping political characterization we argue that CSR can indeed be considered a liberal concept but that it embodies a “varieties of liberalism.” Building theoretically on the work of Michael Freeden on liberal languages, John Ruggie and Karl Polanyi on embedded forms of liberalism, and Michel Foucault on the distinction between classical liberalism and neoliberalism, we provide a conceptual treatment and mapping of (...) the ideological positions that constitute the bulk of modern scholarly CSR debate. Thus, we distinguish between embedded liberalism, classical liberalism, neoliberalism, and re-embedded liberalism. We develop these four orientations in turn and show how they are engaged in “battles of ideas” over the meaning and scope of corporate responsibilities—and how they all remain relevant for an understanding of contemporary debates and developments in the field of CSR and corporate sustainability. El presente artículo tiene como propósito inicial exponer y analizar la oposición que representa el utilitarismo clásico propuesto por Jeremy Bentham frente a la visión deontológica propia de la filosofía de los derechos naturales. Se argumentará que el objetivo del teórico inglés radicaba en trascender los planteamientos netamente filosóficos y argüir por la necesidad de incluir elementos prácticos que permitieran generar acciones tangibles para el bienestar de la mayoría de los individuos. Una vez abordado lo anterior, se demostrará que el (...) principal axioma del utilitarismo –la mayor felicidad para el mayor número posible como medida de lo correcto e incorrecto– requiere, basado en un método de cuantificación edificado en el placer y el dolor, de la intervención del legislador ante las externalidades y de la implementación de ciertas medidas de redistribución de la riqueza que conduzcan al cumplimiento del principio planteado: generar la mayor igualdad y felicidad posible. Nuestro interés en el contenido mental no-conceptual es, principalmente, la articulación de una versión sustantiva (no-trivial) de esta clase de contenido en la experiencia perceptual. El debate acerca del contenido no-conceptual ha girado, en su mayor parte, alrededor de su existencia; y los argumentos que se han ofrecido en su favor abogan por una versión no sustantiva según la cual el contenido no-conceptual es aquel que no satisface ciertos requisitos conceptuales. Así, para desarrollar una versión sustantiva del contenido mental no-conceptual (...) hemos apelado a la versión de la experiencia perceptual de propiedades espaciales ofrecida por Evans (1982 cap. 6). A partir de esto desarrollamos un nuevo argumento a favor del contenido no-conceptual de la experiencia perceptual que lo vincula a la actividad característica de la experiencia perceptual. Por último, exponemos uno de los ataques de McDowell (1996) a la noción de contenido no-conceptual y presentamos nuestras réplicas a este ataque, mostrando su insuficiencia. Al mostrar que la crítica de McDowell no es exitosa, consideramos que podríamos tener una versión del contenido no-conceptual de la experiencia que es inmune a esta línea de argumentación. (shrink)

In this article, we seek to explore the different normative claims made around commons organizing and how the advent of the digital commons introduces new ethical questions. We do so by unpacking and categorizing the specific ethical dimensions that differentiate the commons from other forms of organizing and by discussing them in the light of debates around the governance of participative organizations, the cornerstone of commons organizing (Ostrom in Governing the commons: the evolution of institutions for collective action. Cambridge University (...) Press, Cambridge, 1990). Rather than contesting commons organizing or endorsing it blindly, our goal is to critically reflect on its deontological and instrumental assumptions, and analyze the arguments upholding that it possesses ethical qualities that render it fairer, more equitable and sustainable than other centralized or hierarchical models—as well as any forms of privatization. We conclude by assessing the definitional dislocation of the digital commons where, unlike traditional commons, extractability can be endless and generate unintended consequences such as commodification or alienation. Taking stock of recent debates around the digital commons, we open the debate for future possible research avenues on normative claims, particularly under rapidly changing technological conditions. La función de la educación es difundir las ventajas de vivir en sociedades democráticas, sin embargo, la diáspora de esas ventajas está articulada a intereses políticos y económicos globalizados; su misión: anestesiar a la sociedad para que observe en silencio el desmantelamiento de su proyecto de vida. La educación tradicional no fomenta la habilidad para leer la complejidad de esa realidad democrática. Se enfoca, principalmente, en aleccionar sobre las “ventajas” de la modernidad, donde la mayoría tiene como destino ser masas (...) de asalariados y una minoría, “heredar” la élite. Este documento, propone que para leer esta realidad, la ciudadanía debe ser alfabetizada más allá de la mera técnica que sólo sirva para leer, memorizar y escribir manuales; particularmente la alfabetización debe ser: reflexiva, crítica, basada en el diálogo de saberes y permanente; pero, éticamente coordinada por docentes intelectuales.
